Unless this congressional research found that all the districts that required pre-clearance still had poll tests and sub-50% voter turn outs then they are irrelevant. Those are the factors that determine pre-clearance. Even if congress found that these districts are 10 times more racist than the rest of the country, the VRA would not have given them the authority to oversee their election laws.

If that is what the data suggested, why wouldn't they have used that recent data? Seriously, I want one of you to answer.

because they don't have to, it's within their discretion. They only have to demonstrate the formula works, nothing more. And it does work.

You're essentially arguing Congress isn't allowed to write bad laws. but they are allowed to do that and do it all the time. Supreme Court is not allowed to determine if a formula is outdated, only that it attempts to reach the goals of the legislation which this formula still does as was proven.
