Would there have been a difference if he made the threat by verbally shouting it in public or in print, perhaps?

You should be able look at the situation and make an appropriate decision according to the context.
They should be able to recognize a frivolous complaint simply by looking into a bit. Obviously this kid shouldn't be getting any jail time and shouldn't even be in jail. He didn't actually say anything threatening.
They should have went on facebook, looked at the remark, and then called the lady back and told not to worry about it it wasn't a threat.
